Kate Winders is a member of the firm’s Health Care and Life Sciences, Complex Litigation, and Insurance Coverage practice groups. Kate also leads the firm’s Employment Law practice. Kate regularly represents individuals and businesses before state and federal courts and administrative agencies in a broad range of health care and employment law matters. Kate is a fierce advocate for her client’s interests in her varied roles as a client counselor, business advisor, negotiator or litigator. Having been on both sides of the fight—Kate has represented individuals and employers in her career—she brings a unique perspective to problem solving in and out of the court room. She has also been a client. Kate understands that clients want cost effective, results oriented solutions to their legal problems. Her trademark style is a combination of drive, tenacity, approachability and humor. Like all PSRB lawyers, Kate places a premium on outstanding client communication and an excellent attorney work product. A sampling of Kate’s work includes:


HEALTH CARE

  • Representation of health care professionals (doctors, nurses, pharmacists, dentists) before various administrative boards and in employment contract negotiations.
  • Obtained numerous favorable outcomes for clients in professional licensing matters before the Indiana State Board of Nursing and the Indiana State Board of Pharmacy.
  • Representation of pharmacist in action brought by the Department of Health and Human Services, Office of Inspector General, Office of Investigations to exclude participation in Medicare, Medicaid and all Federal health care programs.
  • Defense of OB/GYN practice group against ADA Access claim brought by the Department of Health and Human Services, Office for Civil Rights division.
  • Successful representation of physician in out-of-state licensing matter.
  • Responded to IN Attorney General audit of Medicaid’s “Lock-in” Program on behalf of individually owned pharmacy client.
  • Representation of long-term care pharmaceutical before the Indiana Board of Pharmacy involving PBM audit and appeal.
  • General compliance counseling on various federal and state health care laws.
  • General legal, corporate and employment law counsel to various healthcare practices.
  • General drafting/negotiation services including: letters of intent, purchase agreements, leases, vendor agreements, pharmacy network agreements, employment agreements, non-solicitation agreements, non-competition agreements, buy/sell agreements, stock agreements, and corporate formation documents.

EMPLOYMENT LAW

  • Representation of executives and other professionals in negotiation of employment agreements and/or severance agreements. 
  • Representation of clients on both sides of disputes involving restrictive covenants, non-compete, non-solicitation agreements, trade secret and wage claims.
  • Counsel business clients on personnel issues including: hiring, suspensions, and termination issues.
  • Draft workplace policies and procedures, job descriptions and employee handbooks.
  • Handle all aspects of litigation at federal and state level including: EEOC and Indiana Civil Rights Commission investigations, employment discrimination, housing discrimination, and ADA access claims.
  • Compliance counseling for Americans with Disabilities Act (“ADA”), Family Medical Leave Act (“FMLA”), Wage and Hour issues, Reductions-in-Force, WARN, ADEA, the Older Worker’s Benefit Protections Act (“OWBPA”), and unemployment compensation.
  • Represented whistleblower in retaliation case under the False Claims Act.
  • Advised and implemented successful reduction in force of non-profit client’s staff resulting in no charges filed.
  • In-House Training on a variety of employment law subjects including:  FMLA, ADA, ADEA and Title VII, Sexual Harassment, Supervisor Training, Workplace discrimination, and hiring and firing techniques.
  • Frequent speaker before industry trade groups on employment law subjects.
