In two recent orders by the Grant Circuit Court, PSRB secured the recovery of significant attorney fees and environmental consultant fees for our client in contempt proceedings arising from opposing parties' blatant violation of a temporary restraining order ("TRO"). The TRO required a short suspension in underground storage tank ("UST") removal activities so that the Court could establish procedures for the parties to preserve evidence regarding alleged UST leakage. The plaintiffs, via their counsel and environmental consultant, disregarded the Court's TRO and proceeded with site work, thereby destroying evidence in the process.
