OSHA Requires Employers to Notify Employees of Any Chromium (VI) Exposure

In revisions to 29 CFR 1910.1026 and CFR 1926.1126 published March 17, 2010, OSHA now requires employers to notify employees of any exposure to chromium (VI), regardless whether the exposure exceeds the permissible exposure level (PEL). This is a change from the proposed rule, which would have required notice only if an exposure exceeded the PEL. This rulemaking is a "direct final rule," which means that although it becomes effective June 15, 2010, there is still an opportunity to comment (and potentially change the rule). The deadline for comments is April 16, 2010.
