Deadline to Appeal Marion County Property Tax Assessments Fast Approaching

The deadline to appeal the 2008 property tax assessment in Marion County, Indiana is December 14, 2009. Under Indiana law, a taxpayer has forty-five (45) days after the date of receipt of the notice of assessment to appeal the assessed value of a property. The notice of assessment may be in the form of the property tax bill itself versus a separate notice of assessment.
Given the current state of the real estate market commercial property owners should carefully analyze their 2008 assessment for both real property and improvements to determine if their property tax assessment for 2008 actually reflects the “true tax value” of their property. There are numerous factors that can and should be taken into consideration when determining a property’s true tax value. Such factors include, but are not limited to, whether the property has any environmental impacts, any professional appraisals which reflect a lower assessed value, actual construction costs for improvements and prior or current sales information for the subject property or comparable properties.
